Liability Waiver and Business Policies

CANCELLATION & WAITLIST POLICY

To ensure fair access to classes and maintain the highest experience for all members, Yoga House RGV enforces the following policy:

1. 4-Hour Cancellation Policy

If you are unable to attend a class you have reserved, you must cancel your reservation at least 4 hours prior to the scheduled class start time.

Cancellations made less than 4 hours before class start time will be considered a late cancel.

2. Late Cancellation & No-Show Policy

• Unlimited Members: A late cancellation or failure to attend (“no-show”) may result in a late cancel fee charged to your account.

• Class Pack Clients: A late cancellation or no-show will result in forfeiture of the class credit.

• Repeated late cancellations or no-shows may result in temporary suspension of advance booking privileges.

This policy ensures other clients have the opportunity to attend fully booked classes.

3. Waitlist Policy

When a class is fully booked, clients may join the waitlist.

If a confirmed participant cancels before the 4-hour window:

• The first client on the waitlist will automatically be added to the class.

• You will receive an automatic email notification confirming your enrollment.

It is your responsibility to ensure your email and notification settings are enabled and up to date.

4. Waitlist Enrollment Inside the 4-Hour Window

If you are added to class from the waitlist within 4 hours of class start time, you are responsible for attending or canceling immediately.

If you do not attend, it will be treated as a late cancel or no-show.

If you no longer wish to be added to class, you must remove yourself from the waitlist before being enrolled.

5. Removing Yourself from the Waitlist

You may remove yourself from the waitlist at any time through your account.

Failure to remove yourself from the waitlist may result in automatic enrollment and applicable late cancellation policies.

6. Policy Enforcement

Cancellation policies are in place to protect the experience of all Yoga House RGV clients and instructors.

Exceptions are not guaranteed and are granted at management’s sole discretion.

NO SHOW AND LATE CANCEL FEE:

Unlimited Members incur a $10 fee.

Multiple Class Pack members will have 1 session deducted.

Drop In Class clients will forfeit 1 purchased session.

ASSUMPTION OF RISK, RELEASE OF LIABILITY,

MEMBERSHIP AUTHORIZATION & ARBITRATION AGREEMENT

This Agreement applies to all Yoga House RGV locations, events, workshops, trainings, memberships, and affiliated activities (collectively, the “Programs”).

By signing below, I agree to the following:

1. Acknowledgment of Physical Activity & Heated Environment

I understand that Yoga House RGV offers yoga, Pilates, barre, strength, mobility, breathwork, workshops, teacher trainings, and other wellness programs that may involve strenuous physical activity.

I acknowledge that:

• Classes may be conducted in heated rooms up to approximately 105°F, including infrared-heated environments.

• Participation may involve stretching, inversion, strength training, balance work, hands-on adjustments, and sustained exertion.

• Risks include, but are not limited to: dehydration, heat exhaustion, heat stroke, muscle strains, sprains, ligament injuries, fractures, cardiovascular complications, dizziness, fainting, aggravation of pre-existing conditions, illness, or in rare cases, serious injury or death.

I voluntarily choose to participate with full knowledge and acceptance of these risks.

2. Medical Representation & Responsibility

I represent and warrant that:

• I am physically fit to participate.

• I have consulted with a physician if I have any medical condition, including but not limited to heart conditions, high or low blood pressure, pregnancy, recent surgery, joint instability, or heat sensitivity.

• I will immediately stop participation if I experience pain, dizziness, nausea, shortness of breath, or discomfort.

I understand it is my ongoing responsibility to inform Yoga House RGV staff of any injuries, medical conditions, or limitations prior to participation.

3. Assumption of Risk

I knowingly and voluntarily assume full responsibility for any and all risks, known or unknown, foreseeable or unforeseeable, associated with:

• Participation in Programs

• Use of studio facilities, props, mats, weights, infrared heaters, showers, and equipment

• Entry into or presence on any Yoga House RGV premises

• Participation in off-site events or community activities

4. Release of Liability & Covenant Not to Sue

To the fullest extent permitted by Texas law, I, on behalf of myself, my heirs, assigns, personal representatives, and next of kin:

Release, waive, discharge, and covenant not to sue Yoga House RGV, its owners, officers, directors, employees, contractors, instructors, volunteers, affiliates, landlords, and agents (collectively, the “Released Parties”) from any and all claims, liabilities, demands, actions, or causes of action arising out of or related to:

• Participation in Programs

• Presence on the premises

• Use of facilities or equipment

Including claims arising from the ordinary negligence of the Released Parties, but excluding gross negligence or intentional misconduct where prohibited by law.

5. Personal Property

Yoga House RGV is not responsible for lost, stolen, or damaged personal property. I assume all risk for belongings brought onto the premises.

6. Pregnancy & Special Conditions

If I am pregnant or have a medical condition, I acknowledge I participate at my own risk and with physician approval. Heated environments may present additional risks.

7. Emergency Medical Care

In the event of injury or medical emergency, I authorize Yoga House RGV to seek emergency medical treatment on my behalf. I understand I am solely responsible for any related medical expenses.

8. Studio Policies & Fees

I agree to abide by all Yoga House RGV policies, including cancellation policies, membership terms, and safety guidelines.

All purchases, memberships, trainings, and class packages are non-refundable, non-transferable, and non-extendable unless otherwise required by law.

Yoga House RGV reserves the right to refuse service for safety, health, or behavioral reasons.

MEMBERSHIP AUTO-DEBIT AUTHORIZATION

This section applies to all recurring memberships, autopay contracts, and installment programs.

9. Authorization for Recurring Charges

I authorize Yoga House RGV to charge my designated credit card, debit card, or bank account for:

• Monthly membership dues

• Installment payments

• Applicable taxes

• Late fees

• Declined payment fees

• Retail or service add-ons I authorize

Charges will occur on the same calendar day each month as my original sign-up date unless otherwise specified.

10. Failed Payments

If a payment is declined:

• Yoga House RGV may reattempt processing.

• A declined payment fee may be assessed.

• My studio access may be suspended until payment is current.

• Accounts past due may be referred to collections.

I am responsible for maintaining current payment information.

11. Cancellation Policy

Membership cancellation requires written notice pursuant to membership terms (typically 30 days unless otherwise specified). Verbal requests do not constitute cancellation.

Charges during required notice periods will still process.

12. No Refund Policy

Membership dues, installment payments, and service fees are non-refundable except where required by law.

13. Chargeback Agreement

I agree not to initiate a chargeback without first contacting Yoga House RGV to resolve any billing dispute. Improper chargebacks may result in termination and collection efforts.

ARBITRATION & DISPUTE RESOLUTION AGREEMENT

14. Agreement to Arbitrate

To the fullest extent permitted by Texas law, any dispute, claim, or controversy arising out of or relating to:

• Participation in Programs

• This Agreement

• Membership billing

• Studio policies

• Injury claims

Shall be resolved exclusively through binding arbitration.

15. Waiver of Jury Trial

I knowingly and voluntarily waive my right to a jury trial.

16. Waiver of Class Actions

I agree that any dispute shall be brought solely in my individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.

17. Governing Law & Venue

This Agreement shall be governed by the laws of the State of Texas.

Arbitration shall take place in Hidalgo County, Texas, or the county of the applicable Yoga House RGV location.

18. Severability

If any provision of this Agreement is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.

PHOTO & MEDIA RELEASE

I grant Yoga House RGV the irrevocable right to photograph, record, and use my image, likeness, voice, and name in any media format for lawful purposes including marketing, advertising, website, social media, promotional materials, and educational content.

I waive:

• Any right to inspect or approve materials

• Any right to compensation

• Any claims related to use of such media

If I do not wish to be photographed or recorded, I understand it is my responsibility to notify staff in writing prior to participation.

ACKNOWLEDGMENT & ELECTRONIC SIGNATURE

I acknowledge that:

• I have read this entire Agreement.

• I understand its contents.

• I understand I am waiving substantial legal rights.

• I voluntarily agree to all terms.

• My electronic signature is legally binding.

RETURNS & REFUNDS POLICY

At Yoga House RGV, we are committed to maintaining clear and consistent policies to ensure fairness for all clients.

1. Services – No Refund Policy

All purchases of services are non-refundable and non-transferable, including but not limited to:

• Class packages

• Memberships

• Workshops

• Events

• Trainings

• Private sessions

Unused classes, packages, or memberships may not be refunded, exchanged, transferred, or credited toward other services.

Exceptions, if any, are granted at management’s sole discretion or where required by law.

2. Membership Billing

Memberships are subject to the Auto-Debit Membership Authorization Agreement.

• Charges will process automatically according to your billing cycle.

• Cancellation requests must follow the required written notice policy.

• Charges processed during required notice periods are not refundable.

Failure to use membership benefits does not constitute grounds for refund.

3. Workshop & Event Cancellations

Workshops, specialty events, and trainings are non-refundable unless otherwise stated in writing for a specific event.

If Yoga House RGV cancels an event, clients will receive either:

• A studio credit, or

• A refund at management’s discretion.

4. Retail Product Returns

Retail product purchases may be returned within 10 days of purchase provided that:

• The item is unused and in new condition

• The item is in original packaging (if applicable)

• Proof of purchase is provided

The following items are not eligible for return:

• Opened or used products

• Worn apparel

• Washed garments

• Sale or clearance items (unless otherwise stated)

Yoga House RGV reserves the right to deny returns that do not meet these conditions.

Approved returns will be refunded to the original form of payment or issued as studio credit at management’s discretion.

5. Schedule Changes & Studio Closures

Every effort is made to maintain a consistent schedule.

However, Yoga House RGV reserves the right to:

• Modify class times

• Change instructors

• Adjust formats

• Cancel classes

• Modify operating hours

Yoga House RGV is not obligated to refund, transfer, extend, or offer compensation for classes that are late, modified, or canceled due to:

• Instructor illness

• Low attendance

• Weather events

• Facility maintenance

• Acts of God

• Circumstances beyond our control

Clients are responsible for checking the live online schedule for updates.

6. Account Responsibility

Each client must maintain an individual online account associated with a unique email address.

Accounts may not be shared between friends, spouses, or family members. Shared accounts may result in suspension of booking privileges without refund.

7. Membership Termination

Yoga House RGV reserves the right to suspend or cancel memberships or service privileges at its sole discretion for:

• Non-payment

• Policy violations

• Disruptive behavior

• Safety concerns

• Abuse of booking policies

Termination does not entitle the client to a refund unless required by law.

8. Policy Changes

Yoga House RGV reserves the right to update or modify this Returns & Refunds Policy at any time without prior notice. Continued participation constitutes acceptance of any updated policy.
